Commission Terms of Service

I reserve the right to decline any commission request.

I reserve the right to cancel and refund your commission request at any time for any/no reason

I will publish on my website any changes to these terms and conditions. Changes will be effective from the date they are published.

Commission Status Key:

Open = Available for booking

Waitlist Open = Limited availability, complete enquiry to find out if space is available. Submitting an enquiry also gets you on the waitlist to be notified of cancellations/unexpected slots opening.

Closed = Not available for commissions currently.

Client Requirements:

You must be 18 years or older to request a commission. 

All commission requests must be emailed to Michelletaikiart@gmail.com or sent via the online form on my website. Commission requests via DM on any of my social media platforms will not be accepted.

Before a quote can be given, you must supply all required details for the commission, including:

  • Dimensions

  • Description of artwork, including character descriptions and reference images

  • Expected Time Frame - When do you need the artwork to be completed?

  • Type of Licence Required (for commercial requests)

Payments:

Payments for commissions are via Paypal and must be made in New Zealand Dollars. If you require an alternative payment method, please contact us.

When I accept your commission, a 75% deposit is required to secure your commission slot. The remaining 25% plus any fees incurred during the commission process, is due when the commission is completed.

Payments are due 7 days after an invoice is issued. We reserve the right to apply a late payment for overdue payments

Delivery:

The time it takes to complete your commission can vary depending on complexity and my availability. I will advise an approximate time frame when discussing your request and prior to your acceptance of a commission slot. If for any reason I cannot complete your commission or if there are delays, I will advise you as soon as possible.

Once your commission is completed and final payment has been received, you will receive the high resolution digital file. Unless discussed prior, I do not offer physical copies of commissioned pieces. If you require physical copies, please let me know when you submit your request.

Revisions:

You will have 2 revisions during the sketch phase which are included in the final price. Any extra changes may be declined or incur an additional fee.

Changes during the rendering stage are limited and may be declined. All changes requested after rendering begins will incur an additional fee.

Communication:

Communication regarding commissions will be via email. DM’s or messages via my social media channels may not receive a response. You may contact me via email at any time for an update on your commission. I aim to respond to communications within 2 business days.

I may contact you from time to time for feedback. If no response is received from you within 5 business days, I will follow up with another email. If I have had no response from you 10 business days after my initial communication, I reserve the right to cancel or postpone your commission without refund.

Copyright & use of commissions:

I retain all copyrights over all commissioned artwork and reserve the right to post the commissioned artwork via social networks, in my portfolio and in publications

You, may upload the commissioned artwork to your personal website or via social networks with credit to me as the artist.

You may not use the commissioned artwork in any commercial capacity including reselling, distributing or using the artwork for promotional purposes and any other use aside from personal unless a commercial license has been agreed upon and purchased prior.

You may not alter the commissioned artwork or edit out my watermark or signature. Unless agreed prior, my full signature will remain on all commissioned artwork but will not interfere with the overall piece.

Refunds & Cancellations:

If you cancel your commission at least 2 weeks prior to your scheduled commission start date, you will be entitled to a full refund of your deposit. If you cancel within 2 weeks prior to your scheduled commission start date or once I’ve started working on your commission, your deposit will be non-refundable.

Once a commission has been completed, I am not obliged to provide any refunds, however, If you are not happy with the finished product, I may offer a full or partial refund at my discretion. If the commissioned piece is not to your liking due to a lack of instructions, references or communication from you, no refund will be offered.

I retain all rights to all commissioned artwork (including sketches and any other interim images shared with you) until full payment has been received. If full payment is not received, I reserve the right to use the commissioned artwork however I see fit including for re-sale as digital products, merchandise or commercial licensing agreements with other parties.
